2014 Political Law, Q17

Towards the end of the year, the Commission on Audit (COA) sought the remainder of its appropriation from the Department of Budge t and Management (DBM). However, the DBM refused because the COA had not yet submitted a report on the expenditures relative to the earlier amount released to it. And, pursuant to the “no report, no release” policy of the DBM, COA is not entitled to any further releases in the meantime. COA counters that such a policy contravenes the guaranty of fiscal autonomy granted by the Constitution. Is COA entitled to receive the rest of its appropriations even without complying with the DBM policy? (4%)

1. Fiscal Autonomy Guarantee
Under Section 5, Article IX-A of the 1987 Constitution, Constitutional Commissions like the Commission on Audit enjoy fiscal autonomy. This constitutional guarantee ensures that their approved annual appropriations shall be automatically and regularly released. Fiscal autonomy preserves the institutional independence of these bodies from executive or legislative control, allowing them to perform their constitutional duties without financial intimidation or political pressure from executive agencies like the Department of Budget and Management.

2. Automatic Release Principle
In Civil Service Commission v. Department of Budget and Management, the Supreme Court held that the constitutional mandate of automatic release means fund disbursements cannot be conditioned upon prior administrative compliance. The Department of Budget and Management cannot enforce a "no report, no release" policy or require mandatory expenditure reports before releasing approved appropriations. Imposing administrative prerequisites on fund releases violates the constitutional guarantee of automatic release.

3. Post-Audit Accountability
While the Commission on Audit enjoys fiscal autonomy and automatic fund releases, it remains subject to financial accountability. Fiscal autonomy does not grant an unbridled license to spend public funds without accounting. However, accountability must be enforced after the funds are released through constitutional post-audit procedures, rather than through prior restraints or fund withholdings by executive departments. Executive agencies cannot use reporting requirements to undermine constitutional fiscal autonomy.
