1. Overbreadth Doctrine
The overbreadth doctrine permits a party to challenge a statute on its face if it sweeps unnecessarily broadly and invades constitutionally protected freedoms, particularly freedom of expression. Under Philippine jurisprudence, a governmental purpose to regulate or penalize unprotected conduct or speech may not be achieved by means that stifle protected expression. As enunciated in Estrada v. Sandiganbayan and Disini v. Secretary of Justice, a statute is facially invalid for overbreadth when a substantial amount of protected speech is prohibited or chilled in the process of regulating unprotected activity.

2. Free Speech Exceptions
Facial challenges grounded on the overbreadth doctrine are an exception to the general rule that laws are presumed constitutional and challenged as applied. In constitutional litigation, facial invalidation based on overbreadth is strictly limited to free speech cases under the First Amendment doctrine. Because penal laws that broadly penalize expression exercise a chilling effect on citizens, courts permit facial overbreadth challenges to prevent self-censorship. Outside the realm of free speech, such as in general penal statutes, the overbreadth doctrine cannot be invoked to strike down a law on its face.

3. Chilling Effect Standard
The chilling effect standard addresses the prospective deterrent impact that overly broad penal laws inflict upon the exercise of fundamental rights. When a criminal statute is drafted with sweeping language, citizens are forced to guess its reach and may choose to suppress their lawful speech out of fear of prosecution. Under Southern Hemisphere v. Anti-Terrorism Council, to invalidate a law for overbreadth, the overbreadth must not only be real but substantial as well, judged in relation to the statute's plainly legitimate sweep. Minor or hypothetical overbreadth does not justify facial invalidation.
