1. Presidential Pardoning Power
Under Article VII, Section 19 of the 1987 Philippine Constitution, the President possesses the executive power to grant reprieves, commutations, and pardons after conviction by final judgment. However, this executive prerogative is not unlimited and remains subject to specific constitutional limitations. Executive clemency extended to individuals convicted of crimes must comply strictly with constitutional conditions precedent, including mandatory agency recommendations required by law, to be legally valid and effective in restoring civil and political rights.

2. COMELEC Recommendation Requirement
Article IX-C, Section 5 of the Constitution mandates that no pardon, amnesty, parole, or suspension of sentence for violation of election laws, rules, and regulations shall be granted by the President without the favorable recommendation of the Commission on Elections. As affirmed in Risos-Vidal v. COMELEC, this requirement acts as a constitutional check on executive clemency. Any presidential pardon issued for an election offense without COMELEC's favorable recommendation is void and produces no legal effect.

3. Disqualification of Candidates
Under the Omnibus Election Code and the Local Government Code, conviction by final judgment for an election offense disqualifies an individual from running for or holding any public office. Because a void executive pardon fails to erase the legal effects of a final conviction, the disqualified individual remains barred from seeking elective office. Only a valid pardon issued in full compliance with constitutional prerequisites can restore an offender's eligibility to run for public office.
