1. Judicial Fiscal Autonomy
Under Article VIII, Section 3 of the 1987 Constitution, the Judiciary enjoys fiscal autonomy, which guarantees full independence and flexibility in allocating and disbursing its approved appropriations. Fiscal autonomy means that appropriations approved by Congress for the Judiciary shall be automatically and regularly released. This constitutional protection ensures that the Judicial branch is shielded from financial coercion, executive interference, or legislative influence, thereby safeguarding its judicial independence.
2. Impeachable Officers Immunity
Under Article XI, Section 2 of the 1987 Constitution, the Ombudsman is an impeachable officer who may only be removed from office through impeachment for constitutional causes. A complaint for disbarment filed against an incumbent Ombudsman cannot prosper during her tenure. Because disbarment results in the loss of membership in the Philippine Bar, which is a mandatory constitutional qualification for the office, disbarring an incumbent Ombudsman would indirectly effect her removal without undergoing constitutional impeachment.
3. Initiation Of Impeachment
Under Article XI, Section 3(5) of the Constitution, no impeachment proceeding shall be initiated against the same official more than once within a period of one year. As settled in Francisco v. House of Representatives, initiation takes place when a verified complaint for impeachment is filed by any Member of the House or by any citizen endorsed by a Member, and is formally referred to the House Committee on Justice. Upon such referral, the one-year bar against filing subsequent impeachment complaints is triggered.
