In 2010, Jon engaged Atty. Teresa’s services for a personal case. Atty. Teresa represented Jon in a BP Big. 22 case filed against him by the spouses Yuki. Jon paid a separate legal fee for Atty. Teresa’s services.
Jon subsequently resigned as CEO of PBB in 2011. In 2012, Atty. Teresa filed on behalf of PBB a complaint for replevin and damages against Jon to recover the car PBB had assigned to him as a service vehicle. Atty. Teresa, however, had not yet withdrawn as Jon’s counsel of record in the BP Big. 22 case, which was still then pending.
Jon filed an administrative case for disbarment against Atty. Teresa for representing conflicting interests and violating the Code of Professional Responsibility. Atty. Teresa countered that since the BP Blg. 22 case and the replevin case are unrelated and involved different issues, parties, and subject matters, there was no conflict of interest and she acted within the bounds of legal ethics.

1. Conflict of Interest
Under Canon III, Section 13 of the Code of Professional Responsibility and Accountability, a lawyer is prohibited from representing conflicting interests without the informed written consent of all affected clients. Conflict of interest exists when a lawyer represents a client against another current client, or when the representation of one client will be adversely affected by the representation of another. The rule guarantees undivided loyalty, complete confidentiality, and zealous representation to every client.
2. Suing Current Client
A lawyer cannot file an action against a current client on behalf of another client, even if the two cases involve completely different subject matters, issues, or parties. The prohibition against suing a current client is absolute unless informed written consent is secured from all parties. Filing a suit against an existing client destroys the trust essential to the attorney-client relationship and constitutes serious professional misconduct.
3. Informed Written Consent
To validly represent conflicting interests, an attorney must obtain the informed written consent of all affected clients after full disclosure of the facts and potential legal risks. Mere verbal acquiescence or the fact that the cases are unrelated does not excuse non-compliance. Without full written disclosure and explicit consent, any dual representation or action filed against a current client remains ethically improper and subject to discipline.
