2014 Remedial Law, Q5

Landlord, a resident of Quezon City, entered into a lease contract with Tenant, a resident of Marikina City, over a residential house in Las Piñas City. The lease contract provided, among others, for a monthly rental of P25,000.00, plus ten percent (10%) interest rate in case of non-payment on its due date. Subsequently, Landlord migrated to the United States of America (USA) but granted in favor of his sister Maria, a special power of attorney to manage the property and file and defend suits over the property rented out to Tenant. Tenant failed to pay the rentals due for five (5) months.
Maria asks your legal advice on how she can expeditiously collect from Tenant the unpaid rentals plus interests due. (6%)
(A) What judicial remedy would you recommend to Maria?
(B) Where is the proper venue of the judicial remedy which you recommended?
(C) If Maria insists on filing an ejectment suit against Tenant, when do you reckon the one (1)-year period within which to file the action?

1. Small Claims Action
Under the Rules on Expedited Procedure, a civil action for money claims not exceeding One Million Pesos (P1,000,000), exclusive of interest and costs, falls under the Procedure for Small Claims Cases. This judicial remedy provides an expeditious and inexpensive process for recovery of unpaid rentals and accrued contractual interest. Small claims actions are conducted using simplified statement of claim forms without formal trial pleadings, technical evidentiary rules, or mandatory representation by legal counsel.

2. Personal Action Venue
Under Rule 4, Section 2 of the Rules of Court, personal actions may be commenced and tried where the plaintiff or any of the principal plaintiffs resides, or where the defendant or any of the principal defendants resides, at the election of the plaintiff. In small claims actions for unpaid lease obligations, the venue lies either in the municipality or city where the landlord resides or where the tenant resides. The location of the leased real property is immaterial in purely personal collection suits.

3. Unlawful Detainer Reckoning
Under Rule 70 of the Rules of Court, an action for unlawful detainer must be filed within one year from the date of the last demand to vacate the premises and pay rentals. Where the tenant's initial entry was lawful but became illegal due to non-payment of rent, the one-year prescriptive period does not run from the default date, but is strictly reckoned from the date when the tenant receives the final demand letter to vacate.
