1. Kidnapping with Rape
Under Article 267 of the Revised Penal Code, as amended, when a person deprives another of liberty and rapes the victim during captivity, the offense constitutes the special complex crime of kidnapping and serious illegal detention with rape. This single composite offense absorbs all individual acts of sexual assault committed throughout the period of unlawful detention. The law punishes the illegal detention and sexual violation as a single indivisible felony carrying the capital penalty.

2. Deprivation of Liberty
Under Article 267 of the Revised Penal Code, serious illegal detention is committed by any private individual who kidnaps or detains another, depriving the victim of liberty. The detention becomes serious when it lasts for more than three days, or when the victim is a female, or when the detention is accompanied by sexual assault. Taking advantage of an incapacitated or sleeping passenger to transport her to a deserted location for detention satisfies the elements of illegal detention.

3. Special Complex Crimes
Under Philippine criminal law, a special complex crime is a composite offense specifically created and defined by statute where two or more distinct crimes are treated as a single indivisible felony with a single penalty. Unlike ordinary complex crimes under Article 48 of the Revised Penal Code, special complex crimes like kidnapping with rape do not allow separate prosecutions for the constituent crimes, as all acts committed during the period of detention are absorbed into the main offense.
