While in his Nissan Patrol and hurrying home to Quezon City from his work in Makati, Gary figured in a vehicular mishap along that portion of EDSA within the City of Mandaluyong. Both vehicles – more than 5 years old – no longer carried insurance other than the compulsory third party liability insurance. Gary suffered physical injuries while his Nissan Patrol sustained damage in excess of Php500,000.
III(A) As counsel for Gary, describe the process you need to undertake starting from the point of the incident if Gary would proceed criminally against Horace, and identify the court with jurisdiction over the case. (3%)

1. Reckless Imprudence Process
To initiate a criminal prosecution for reckless imprudence resulting in physical injuries and damage to property under Article 365 of the Revised Penal Code, the offended party must file a complaint-affidavit supported by police blotter reports, medical certificates, and repair estimates before the Office of the City Prosecutor of Mandaluyong, where the collision occurred. Since the penalty for reckless imprudence resulting in physical injuries and property damage falls within the jurisdiction of First Level Courts, the resulting criminal Information will be filed with and tried by the Metropolitan Trial Court of Mandaluyong.

2. Independent Civil Action
Under Article 2176 of the Civil Code in relation to Rule 111, Section 3 of the Rules of Court, an independent civil action for damages based on quasi-delict may be instituted separately from the criminal action without need of reservation. This civil action proceeds independently of the criminal prosecution and requires only a preponderance of evidence to establish liability. The plaintiff must prove the defendant's negligent act, such as distracted driving using a cellular phone in violation of Republic Act No. 10913, the resulting damage, and the direct causal connection between them.

3. Defenses and Evidence
In an independent civil action for quasi-delict, the plaintiff relies on evidence including official police traffic accident reports, eyewitness testimonies, photographs of vehicle damage, medical receipts, and proof of lost income. Conversely, the defendant driver may raise affirmative defenses such as fortuitous event, mechanical defect, or contributory negligence under Article 2179 of the Civil Code. If contributory negligence is proven, it will not bar recovery but will mitigate the damages awarded. Furthermore, establishing that the plaintiff was guilty of sole proximate negligence would completely defeat the civil claim.
