1. Adultery Prosecution Right
Under Article 344 of the Revised Penal Code and Rule 110 of the Rules of Court, the crime of adultery is a private offense that can only be prosecuted upon a sworn complaint filed by the offended spouse. The law grants the exclusive right to institute the criminal action solely to the offended husband. If the offended husband dies without filing a complaint, his right of action is extinguished. His relatives or legal heirs cannot file the criminal complaint on his behalf, making any contemplated adultery prosecution after his death legally unviable.

2. Impugning Child Legitimacy
Under Articles 170 and 171 of the Family Code, the legitimacy of a child born within 180 days following the dissolution of the marriage or the death of the husband may be impugned by the husband's heirs under exceptional circumstances. If the husband dies before the expiration of the period for bringing the action, or after the birth of the child without bringing the suit, his legal heirs are vested with standing to file the action. Impugning paternity is permissible when physical impossibility of access or biological evidence disproves paternity.

3. Direct Civil Action
Jurisprudence strictly mandates that the legitimacy or filiation of a child cannot be collaterally attacked in an administrative, criminal, or probate proceeding. The issue of legitimacy must be direct and frontally raised in a special civil action specifically instituted for that purpose before the proper Family Court. Consequently, interested heirs seeking to dispute a child's status as a legitimate issue of the deceased husband must initiate an independent, direct judicial action rather than asserting non-paternity as an collateral issue in another lawsuit.
