1. Irrevocability Rule
Under Section 76 of the National Internal Revenue Code, once a corporate taxpayer selects the option to carry over and apply excess quarterly income tax against tax liabilities for succeeding taxable years, that choice becomes irrevocable for that taxable period. A taxpayer who previously elected the carry-over option in its annual final adjustment return cannot subsequently claim a tax refund or tax credit certificate for that same overpayment.

2. Annual Option Exercise
The irrevocability rule applies on a taxable period basis to the specific overpayment realized in that year. When a corporation realizes a new and distinct income tax overpayment in a subsequent taxable year, it retains full statutory freedom to choose between carrying over that new overpayment or claiming it as a cash tax refund in its annual return.

3. Dual Overpayment Treatment
When an annual income tax return reflects both a prior year's carried-over tax overpayment and a current year's new overpayment, the two amounts are governed by distinct legal rules. The prior year's overpayment remains subject to the irrevocability rule and must be carried over continuously, whereas the current year's overpayment can be validly claimed as a cash refund if the refund option is selected.
