2016 Political Law, Q1

The contents of the vault of ABC company consisting of cash and documents were stolen. Paulyn, the treasurer of ABC, was invited by the Makati City Police Department to shed light on the amount of cash stolen and the details of the missing documents. Paulyn obliged and volunteered the information asked. Later, Paulyn was charged with qualified theft together with other suspects. Paulyn claims her rights under the Constitution and pertinent laws were blatantly violated. The police explained that they were just gathering evidence when Paulyn was invited for a conference and she was not a suspect at that time. Rule on her defense. (5%)

1. Custodial Investigation Stage
Under Article III, Section 12 of the 1987 Constitution, custodial investigation rights attach only when investigation ceases to be a general inquiry into an unsolved crime and begins to focus on a particular suspect in police custody. Custodial investigation refers to questioning initiated by law enforcement officers after a person has been taken into custody or deprived of freedom of action in a significant way. When an individual is merely invited as a witness to shed light on an unsolved crime without being placed under police restraint, custodial investigation rights do not apply.

2. Police Invitation Nature
A police invitation to a corporate officer to provide information regarding stolen property does not constitute a custodial interrogation. When an individual voluntarily obliges to a police request for information during a routine conference or fact-finding stage without being treated as a suspect or subjected to coercive interrogation, any statement provided is given voluntarily outside custodial investigation. Rights under Section 12, including the right to counsel and to remain silent, protect suspects under police detention, not voluntary informants during general inquiries.

3. Admissibility Of Statements
Voluntary statements given during a general police inquiry prior to being identified as a suspect or taken into custody are admissible in evidence. The constitutional guarantee requiring warning of rights and assistance of counsel applies strictly to extrajudicial admissions extracted during custodial interrogation. Because statements made during an uncoerced, non-custodial conference fall outside the ambit of custodial investigation, the lack of prior Miranda warnings or assistance of counsel does not render such voluntary disclosures inadmissible or violate constitutional rights.
