1. Forbidden Office Prohibition
Under Article VI, Section 13 of the 1987 Constitution, no Senator or Member of the House of Representatives may be appointed to any civil office created, or the emoluments whereof were increased, during the term for which they were elected. This constitutional prohibition creates an absolute disqualification designed to prevent legislators from enacting laws that create lucrative public offices or enhance existing civil positions for their own personal benefit or future presidential appointment.

2. Effect of Resignation
Voluntary renunciation of office, such as resignation, does not shorten or terminate the duration of the constitutional prohibition on forbidden offices. The term for which a Senator or Representative was elected remains six years or three years, respectively, regardless of early resignation. Consequently, a legislator who resigns during their term remains constitutionally disqualified from being appointed to any office created during that original elected term until its full expiration.

3. Incompatible Office Distinction
Constitutional law distinguishes a forbidden office from an incompatible office under Article VI, Section 13. An incompatible office prohibits a sitting legislator from holding any other government office during their tenure unless they forfeit their seat. In contrast, a forbidden office imposes a strict ban on appointment to any office created or augmented during the legislator's elected term, an absolute prohibition that persists even if the legislator ceases to hold legislative office.
