"Domicile" - Art 50 CC "The place of their habitual residence." Denotes a fixed permanent residence to which, when absent, one has the intention of returning. (Uytengsu v Republic. An individual's "permanent home", "a place to which, whenever absent for business or for pleasure, one intends to return" (Ong v Republic)

Article 41 of NCC:  A fetus with an intra-uterine life of less than 7 months is considered born if it survives after 24 hours after its complete delivery from the maternal womb. (Therefore, if fetus is 7 months but does not survive for 24 hours, it is still considered born. Also scientifically, fetus less than 6 months are not viable and will never be born alive)
