2023 Remedial Law, Q17

The Supreme Court suspended Atty. Irish for one year in an administrative case filed against her for Gross Misconduct. During the effectivity of her suspension, Janet appointed her as attorney-in-fact in an execution sale arising from a civil case that she previously handled. At the execution sale, Atty. Irish took part in the bidding and negotiations as regards the payment of the judgment award. Atty. Elvie, the opposing counsel in the civil case, questioned the appearance by Atty. Irish during the execution sale because of her suspension. Atty. Irish argued that she was merely acting as an attorney-in-fact of Janet, which was not tantamount to the practice of law. Do you agree with Atty. Irish? Explain your answer.

1. Practice of Law
Under Philippine jurisprudence, the practice of law is not restricted to appearances before judicial courts or quasi-judicial tribunals. It encompasses any activity, in or out of court, that requires the application of legal knowledge, legal procedure, professional training, and specialized legal skill. Activities such as negotiating execution sales, bidding on judgment awards, and advising clients on legal remedies fall squarely within the definition of practicing law because they involve interpreting and applying procedural rules governing the satisfaction and enforcement of court judgments.

2. Effect of Suspension
An order of suspension issued by the Supreme Court completely deprives a lawyer of the privilege to practice law during the entire period of suspension. A suspended lawyer is strictly prohibited from holding themselves out as an attorney, rendering legal advice, representing clients in any capacity requiring legal knowledge, or engaging in legal tasks even outside the courtroom. Any attempt by a suspended attorney to continue performing acts that constitute the practice of law violates the explicit disciplinary order of the Supreme Court and constitutes unauthorized practice of law.

3. Attorney in Fact
A suspended attorney cannot circumvent an order of suspension by acting under the legal instrument of a power of attorney or designating themselves as an attorney-in-fact. While a non-lawyer or agent may perform purely administrative or material acts as an attorney-in-fact, an attorney-in-fact cannot perform legal representation or engage in acts requiring legal skill. When a suspended lawyer performs acts that inherently constitute the practice of law under the pretense of acting as an attorney-in-fact, the law looks past the designation and punishes the unauthorized practice.
