1. Kidnapping for Ransom
Under Article 267 of the Revised Penal Code, as amended by Republic Act No. 7659, kidnapping is committed when a private individual deprives another of liberty. When the kidnapping or detention is committed for the purpose of extorting ransom from the victim or any other person, the crime becomes kidnapping for ransom. The demand for ransom is a qualifying circumstance that automatically mandates the imposition of the death penalty under the original text of the statute, regardless of the victim age, gender, or length of detention.

2. Special Complex Crime
Under the last paragraph of Article 267 of the Revised Penal Code, when a victim is killed or dies as a consequence of the detention, the offense is classified as a special complex crime of kidnapping with homicide or murder. It is immaterial whether the killing was purposely sought, committed to conceal the crime, or occurred merely as an afterthought during captivity. The law treats the entire event as a single composite offense carrying a single indivisible penalty for all participating offenders.

3. Principles of Conspiracy
Under Article 8 and Article 17 of the Revised Penal Code, when a conspiracy to commit kidnapping for ransom is established, the act of one co-conspirator is legally considered the act of all. Each conspirator is held criminally liable as a principal for the special complex crime of kidnapping for ransom with homicide, even if he did not personally participate in inflicting the fatal injuries upon the victim, provided the killing occurred during and by reason of the detention.
