1. Insurable Interest Concept
Under Section 14 of the Insurance Code (Republic Act Number 10607), insurable interest in property may consist of an existing interest, an inchoate interest founded on an existing interest, or an expectancy coupled with an existing interest. A person has an insurable interest in property whenever that person derives a direct pecuniary benefit from its preservation or suffers a direct pecuniary loss or damage from its destruction, loss, or injury.
2. Mortgagor and Mortgagee
In property insurance, both the mortgagor and the mortgagee have separate and distinct insurable interests in the mortgaged property. The mortgagor or buyer in a secured transaction has an insurable interest to the full value of the property, based on legal ownership and liability for the debt. Conversely, the mortgagee or secured creditor possesses an insurable interest in the mortgaged property only to the extent of the unpaid credit balance or debt secured.
3. Personal Property Security
Under the Personal Property Security Act (Republic Act Number 11057), a security agreement creates a security interest in personal property to secure payment or performance of an obligation. Perfection of the security interest establishes priority against third parties but does not extinguish the debtor's underlying ownership or the secured creditor's insurable interest. Both parties retain distinct insurable interests corresponding to their respective financial exposures and legal rights in the encumbered property.
