1. Exclusive Property Disposition
Under Article 111 of the Family Code, either spouse may mortgage, encumber, alienate, or otherwise dispose of his or her exclusive property without needing the consent of the other spouse. Because exclusive property remains under the sole ownership and management of the titled owner, the consent of the non-owning spouse is not a legal requisite for the validity of a contract of donation involving exclusive personal or real property.
2. Void Donations Exception
Under Article 739(1) of the Civil Code, donations made between persons who were guilty of adultery or concubinage at the time of the donation are void ab initio. This statutory prohibition requires that the illicit adulterous relationship exist concurrently with the execution of the donation. If the concubinage or adultery had already ceased prior to the donation, the statutory prohibition under Article 739(1) does not apply.
3. Motive in Donations
Under Article 87 of the Family Code, donations between spouses or persons cohabiting as husband and wife without a valid marriage are void. However, when a former lover donates property to an ex-partner after cohabitation or an illicit affair has completely terminated, and the donation is given on the occasion of the recipient's marriage to another person rather than in consideration of an ongoing illicit affair, the donation is valid.
