2022 Labor Law, Q7

Two legitimate labor organizations (Union Jack and Union Jill) are competing to become the first sole and exclusive bargaining agent (SEBA) in Maharlika Company. The unions agree to a consent election without involving the Bureau of Labor Relations (BLR). Union Jack garners an overwhelming majority of the valid votes cast during the consent election. Negotiation for a collective bargaining agreement (CBA) commences, and while this is ongoing, a third union, Union Jumble, files with the BLR a petition for certification election seeking certification as the SEBA in Maharlika Company. Union Jack opposes the petition, arguing that no petition for certification election can be filed within one year from the consent election, and during the CBA negotiation. Is Union Jack correct? 1. Certification Year Bar
Under Department Order No. 40-03 (Rule VIII, Section 14), no petition for certification election may be filed within one year from the date of issuance of a final certification election result or consent election outcome. This rule, known as the Certification Year Bar, provides a one-year period of industrial peace following the selection of an exclusive bargaining representative. During this one-year period, the certified labor organization is protected from representation challenges by rival unions, allowing the recognized bargaining representative to focus on representing employee interests and organizing collective bargaining negotiations.

2. Negotiation Bar Rule
The Negotiation Bar Rule prohibits the filing of a petition for certification election while the certified or recognized sole and exclusive bargaining agent has commenced and sustained collective bargaining negotiations in good faith with the employer within the one-year certification period. If collective bargaining negotiations have formally started within the one-year period, rival labor unions are barred from challenging the incumbent union's representation status. This statutory bar prevents rival unions from disrupting ongoing collective bargaining discussions and ensures stability in employer-employee contract negotiations.

3. Consent Election Effect
A consent election is an election voluntarily agreed upon by competing labor unions, with or without the intervention of the Bureau of Labor Relations, to determine the sole and exclusive bargaining agent of employees in an appropriate bargaining unit. The results of a valid consent election carry the same legal weight as a formal certification election conducted by the labor department. Consequently, the labor organization that secures the majority of valid votes cast in a consent election gains exclusive bargaining rights and immediate protection under representation bars.
