1. Jurat Definition
A jurat is an act in which an individual on a single occasion appears in person before a notary public and presents an instrument or document. The affiant signs the instrument in the notary's presence and takes an oath or affirmation administered by the notary public that the contents of the instrument or document are true and correct. Unlike an acknowledgment, a jurat is executed for affidavits and sworn statements where the affiant affirms under penalty of perjury the truthfulness of the statements made in the document.
2. Notarial Practice Rules
Under the 2004 Rules on Notarial Practice (A.M. No. 02-8-13-SC), a notary public is strictly prohibited from executing a jurat unless the signatory personally appears before the notary. The affiant must be personally known to the notary or identified through competent evidence of identity. Competent evidence of identity refers to at least one current identification document issued by an official agency bearing the photograph and signature of the individual. Failure of the notary to require personal appearance and valid identification invalidates the jurat and subjects the notary to administrative revocation of commission.
3. Notarial Register Entries
After completing a jurat, the notary public must record the transaction in the official notarial register. The entry must specify the document number, page number, book number, and series year matching the notation printed on the jurat block itself. Additionally, the notary must record the date, time, title or nature of the instrument, and the competent evidence of identity presented by the affiant. Maintaining accurate notarial records ensures public accountability, deters document falsification, and preserves the evidentiary presumption of regularity accorded to notarized public documents under Philippine procedural law.
