1. ISL Exceptions
Under Section 2 of Act No. 4103, known as the Indeterminate Sentence Law, the law explicitly lists disqualifications and exceptions where an indeterminate sentence cannot be imposed. Specifically, persons whose maximum term of imprisonment does not exceed one year are disqualified from receiving an indeterminate sentence. In such instances, the court is legally mandated to impose a straight penalty rather than a sentence consisting of a minimum and maximum term.

2. Arresto Menor Duration
Article 27 of the Revised Penal Code defines the duration of light penalties, specifically providing that arresto menor ranges from one day to thirty days. Because thirty days is substantially less than the statutory threshold of one year, any offense punishable by arresto menor automatically falls under the express exceptions of Section 2 of the Indeterminate Sentence Law.

3. Straight Penalty Imposition
When an offense falls under the statutory exceptions of Act No. 4103, the sentencing judge must issue a straight penalty instead of an indeterminate sentence range. The judge fixes a single specific term of imprisonment within the period prescribed by law for arresto menor, taking into consideration any attending mitigating or aggravating circumstances under the rules of the Revised Penal Code.
