1. Direct Assault Elements
Under Article 148 of the Revised Penal Code, direct assault of the second form is committed by any person who, without a public uprising, attacks, employs force, seriously intimidates, or seriously resists any person in authority or his agent while engaged in the performance of official duties or on the occasion thereof. The essential requisites require that the offender knew the victim was a person in authority or an agent, and that force or violence was applied directly against them.
2. Persons in Authority
Under Article 152 of the Revised Penal Code, a person in authority is any person directly vested with jurisdiction to govern and execute laws. The law explicitly provides that teachers, professors, and deans of duly recognized public or private schools, colleges, and universities are deemed persons in authority while in the performance of their professional duties or on the occasion thereof. Consequently, physically attacking a school dean performing administrative duties constitutes direct assault under Article 148.
3. Agents of Authority
Under Article 152 of the Revised Penal Code, an agent of a person in authority is any person who, by direct provision of law or by election or by competent appointment, is charged with the maintenance of public order and protection of life and property. Crucially, Article 152 explicitly deems any person who comes to the aid of a person in authority as an agent of a person in authority. Intervening to protect a school dean elevates the intervener to an agent.
