2018 Remedial Law, Q22

Danica obtained a personal loan of PhP 180,000 from Dinggoy, payable in 18 equal monthly installments of PhP 10,000 until fully paid. In order to complete her payment at an earlier date, Danica instead paid PhP 20,000 monthly, and continued doing so until the 15th month, which payments Dinggoy all accepted. Later on, she realized that she had overpaid Dinggoy by 100% as she should have already completed payment in nine (9) months. She demanded the return of the excess payment, but Dinggoy completely ignored her. Thus, Danica availed of the Rules of Procedure for Small Claims Cases by filing before the Municipal Trial Court (MTC) a statement of claim, together with the required documents.
Should the MTC proceed with the case under the: (i) Revised Rules Summary Procedure; (ii) the Rules of Procedure for Small Claims; or (iii) the regular procedure for civil cases? (5%)

1. Small Claims Scope
Under the Rules on Expedited Procedures in First Level Courts (A.M. No. 08-8-7-SC), small claims actions cover purely civil money claims where the total amount of the demand does not exceed PhP 1,000,000.00, exclusive of interest and costs. The procedure applies to actions for payment or reimbursement of money arising from contracts of loan, fault, negligence, quasi-contracts, or services. Because the primary relief sought is purely monetary and falls within the statutory monetary threshold, the first-level court must apply the expedited small claims procedure rather than summary or regular civil procedure.

2. Solutio Indebiti Nature
Solutio indebiti is a quasi-contractual obligation created by law when something is received when there is no right to demand it, and it was unduly delivered through mistake. Under Article 2154 of the Civil Code, the person who unduly receives such payment has an obligation to return it. A claim for reimbursement based on solutio indebiti constitutes a purely civil demand for money. When the amount claimed under solutio indebiti does not exceed PhP 1,000,000.00, it falls squarely within the subject-matter scope of the Rules of Procedure for Small Claims.

3. Expedited Procedure Purpose
The Rules of Procedure for Small Claims were promulgated to provide an inexpensive, informal, and expeditious disposition of small money claims before first-level courts. Formal pleadings, strict rules of evidence, and representation by lawyers are generally excluded to ensure swift access to justice. Where a complaint seeks strictly the recovery of a specific sum of money within the jurisdictional ceiling, court docketing and trial proceedings must strictly adhere to small claims rules, preventing unnecessary procedural delays associated with regular civil litigation.
