1. Twin Notice Rule
Procedural due process in just cause dismissals requires serving two written notices to the employee. The first notice, or notice to explain, must specify the ground or grounds for termination and give the employee a reasonable opportunity to submit a written explanation, which must be at least five calendar days. The second notice, or notice of decision, informs the employee of the employer's decision to dismiss them after considering their explanation and evidence. Failure to serve both written notices invalidates procedural due process.

2. Opportunity to Defend
The statutory requirement of an ample opportunity to be heard means that an employee must be afforded a real chance to defend themselves against the charges. This includes sufficient time to prepare an explanation, present supporting evidence, and respond to allegations. While a formal trial-type hearing is not mandatory unless requested by the employee or required by company rules, the employer must conduct a fair and meaningful opportunity to clarify facts before imposing dismissal.

3. Five-Day Explanation Period
Under prevailing labor regulations and Supreme Court jurisprudence, the reasonable period given to an employee to answer the charges in the first written notice must be at least five calendar days. Providing a shorter timeframe, such as forty-eight hours, deprives the worker of adequate time to consult counsel or prepare a proper defense. Dismissing an employee after granting less than the statutory five-day period violates procedural due process.
