1. Valid Retrenchment Requisites
Under Article 298 of the Labor Code, retrenchment is an authorized cause for terminating employment to prevent serious business losses. To be valid, retrenchment must be reasonably necessary and likely to prevent substantial, real, and imminent losses. The employer must serve separate written notices on both the affected employees and the DOLE at least one month prior to the intended date. Management must exercise good faith, implement fair selection criteria, and pay mandatory separation pay equivalent to one-half month salary per year of service or one month pay, whichever is higher.

2. Proof of Losses
The employer carries the burden of proving actual or imminent substantial business losses through sufficient and convincing evidence. Jurisprudence requires independently audited financial statements to establish serious financial reverses rather than self-serving documents. A temporary decline in income or gross revenues is insufficient to justify retrenchment. Management must also show that retrenchment was resorted to as a measure of last resort after adopting prior cost-cutting measures, such as hiring freezes and expense reductions.

3. Fair Selection Criteria
In implementing a retrenchment program, the employer must adopt fair and reasonable criteria in determining who among the employees will be dismissed and who will be retained. Acceptable selection standards include status, efficiency, seniority, physical fitness, age, and financial hardship for workers. Disregarding an employee's status and length of service without valid cause renders the retrenchment arbitrary and illegal. Compliance with fair criteria ensures that management prerogative is exercised in good faith without defeating the employees' constitutional right to security of tenure.
