1. Destination Principle VAT
Under Section 108(A) of the National Internal Revenue Code, Value-Added Tax is imposed on the sale or lease of goods, properties, or services performed in the Philippines. Under the destination principle and cross-border doctrine, goods and services are taxed in the country where they are consumed or utilized. The place where the lease contract was signed or executed is immaterial. Because the subject real property is located, leased, and utilized within Philippine territory, the lease transaction is subject to value-added tax under Philippine revenue laws.

2. Real Property Lease
Section 108(A) of the Tax Code explicitly includes the lease of real properties among transactions subject to twelve percent Value-Added Tax. Real property is immovable by nature and permanently situated within the territory of the Philippines. Regardless of whether the lessor or lessee is a foreign entity, or whether contract negotiations occurred abroad, the location of the real property governs taxability. Leases of residential real estate situated in the Philippines remain subject to value-added tax unless explicitly exempt under statutory threshold provisions.

3. Inapplicability of Zero-Rating
Under Section 108(B) of the National Internal Revenue Code, zero-rated VAT applies exclusively to specified export services rendered to non-residents that are performed in the Philippines. A lease of domestic real property does not qualify for zero-percent VAT rating simply because the lessee is a non-resident foreign corporation. Since the real property is situated and physically utilized within Philippine territory, the lease payments constitute taxable gross receipts derived from a local real estate lease transaction subject to standard output VAT.
