1. Importation Timing Rules
Under Section 1202 of the Tariff and Customs Code, as amended, importation begins when the carrying vessel or aircraft enters the jurisdiction of the Philippines with the intention to unlade cargo. Importation is deemed terminated upon ultimate payment of duties, taxes, and other charges, and legal permit for withdrawal has been granted, or in case the goods are free of duty, when they have legally left the jurisdiction of customs authorities.

2. Automatic Review Mechanism
Under Section 2315 of the Tariff and Customs Code, a decision of the Collector of Customs in a forfeiture case that is adverse to the Government is automatically reviewed by the Commissioner of Customs. This automatic review mechanism ensures that state revenues are protected against improper release of seized goods without requiring a formal administrative appeal by government prosecutors or customs officials.

3. Secretary Review Power
When the Commissioner of Customs affirms a decision of the Collector of Customs that is adverse to the Government in a forfeiture proceeding, or when the Commissioner reverses a Collector's decision favorable to the Government, the case is automatically appealed to the Secretary of Finance. This multi-tiered automatic appeal safeguard prevents finality of adverse administrative decisions until high-level executive review is completed.
