1. Separation Pay Computation
Under Article 298 of the Labor Code, an employee terminated due to retrenchment to prevent losses is entitled to separation pay equivalent to one month pay or at least one-half month pay for every year of service, whichever is higher. Separation pay aims to provide financial support to workers who lose their employment through no fault of their own. Statutory retrenchment pay must be computed accurately using the full monthly salary base established by law and jurisprudence.

2. Salary Base Inclusion
In labor jurisprudence, the term monthly salary or one month pay used as the computational base for separation pay is not limited to basic wage. It encompasses all regular allowances, cost of living allowances, representation allowances, and sales commissions earned by the employee. As long as these monetary benefits are regularly received as compensation for services rendered, they form an integral part of the employee's regular pay base for calculating statutory separation benefits.

3. Regular Commission Treatment
Sales commissions regularly earned by employees constitute part of their wage or compensation for services rendered. When calculating separation pay for sales personnel, regular commissions must be integrated into the monthly salary base alongside basic pay and statutory allowances. Excluding regular commissions or regular allowances from separation pay computation diminishes statutory employee benefits and violates established labor standards jurisprudence.
