1. Qualified Theft Teller
Under Article 310 of the Revised Penal Code, theft is qualified when committed with grave abuse of confidence. A bank teller who receives checks or cash deposited by bank clients acquires physical possession rather than juridical possession of the funds. Because the bank teller holds only material possession by virtue of her employment position, misappropriating or unlawfully crediting the deposited funds to another account constitutes qualified theft rather than estafa or malversation.

2. Requisites of Conspiracy
Under Article 8 of the Revised Penal Code, conspiracy exists when two or more persons come to an agreement concerning the commission of a felony and decide to commit it. To establish criminal liability as a co-conspirator or accomplice, the prosecution must prove knowledge of the criminal design and intentional participation in the execution of the crime. An innocent third party who relies in good faith upon a misrepresentation lacks criminal intent and cannot be held liable.

3. Physical versus Juridical
Under Philippine criminal jurisprudence, distinguishing between theft and estafa hinges on the nature of possession transferred to the offender. Juridical possession gives the transferee a right over the property enforceable against the owner, whereas material or physical possession conveys mere custody. Bank tellers receive deposits as mere custodians for the financial institution. Appropriating funds held in physical custody satisfies the element of taking without consent, defining the crime as qualified theft.
