1. Diplomatic Immunity
Under Article 14 of the Civil Code, the Vienna Convention on Diplomatic Relations, and Republic Act No. 75, diplomatic agents accredited to the Philippines enjoy absolute immunity from local criminal jurisdiction. Diplomatic immunity serves as a statutory and treaty-based exception to the principle of generality in criminal law. Accredited foreign diplomatic agents, such as ambassadors, ministers, and foreign diplomats, cannot be arrested, detained, or criminally prosecuted in Philippine courts for any felony or offense committed within the territorial jurisdiction of the Philippines during their diplomatic mission.

2. Generality Principle Exception
Under Article 2 of the Revised Penal Code and principles of public international law, Philippine penal laws are binding upon all persons who live or sojourn in Philippine territory. However, this generality principle is subject to recognized exceptions under international treaties, executive agreements, and special statutes. Duly accredited diplomatic officers are entirely exempt from domestic criminal jurisdiction. Consequently, even if a diplomat commits a crime such as reckless imprudence resulting in homicide, local courts lack criminal jurisdiction to try or punish the foreign diplomatic agent.

3. Scope of Immunity
Diplomatic immunity from criminal jurisdiction under the Vienna Convention on Diplomatic Relations is absolute and extends to all offenses, regardless of whether the act was committed in the performance of official duties or during private activities. Minor infractions or administrative violations, such as driving with an expired driver's license or committing traffic violations, do not divest an accredited foreign diplomat of immunity from local criminal prosecution. The sole legal recourse for the host state is to declare the diplomat persona non grata or request a diplomatic waiver.
