1. Conjugal Share Waiver
Under Revenue Regulations No. 12-2018, the waiver or renunciation by the surviving spouse of her fifty percent net share in the conjugal partnership or absolute community property after the dissolution of marriage in favor of specific heirs is subject to donor's tax. Because the surviving spouse is already the absolute owner of her undivided half of the conjugal estate upon the decedent's death, waiving that specific share constitutes a gratuitous transfer of personal property subject to statutory donor's tax.
2. Renunciation of Inheritance
A general, repudiation or renunciation of an inheritance by an heir, including a surviving spouse, is not subject to donor's tax under estate tax regulations. When an heir renounces a hereditary share indiscriminately without designating a specific beneficiary, the renounced share automatically accrues to the remaining co-heirs by operation of law under accretion. Because the renouncing heir never accepts ownership of the inherited property, no taxable gift or gratuitous transfer of personal wealth occurs.
3. Partial Taxability Rule
When a surviving spouse simultaneously waives both her share in the conjugal property and her inheritance from the decedent's estate in favor of her children, distinct tax rules apply. Donor's tax is correctly assessed on the renunciation of the conjugal share because it represents an alienation of personal property. Conversely, the general renunciation of the hereditary share in the net estate remains tax-exempt, rendering any deficiency donor's tax assessment on the repudiated inheritance legally improper.
