1. Quasi-Delict Liability
Under Article 2176 of the Civil Code, whoever by act or omission causes damage to another, there being fault or negligence, is obliged to pay for the damage done. A private construction company that leaves tools unattended on a public street creates an unreasonable hazard. When such negligence directly causes physical injuries and consequential emotional distress, the negligent party is civilly liable for actual and moral damages under Article 2219 of the Civil Code.
2. Municipal Public Liability
Under Article 2189 of the Civil Code, provinces, cities, and municipalities are liable for damages for the death of, or injuries suffered by, any person by reason of the defective condition of roads, streets, bridges, public buildings, and other public works under their control or supervision. An open, unguarded manhole on a public street constitutes a dangerous defect, rendering the local government unit solidarily or concurrently liable for injuries sustained by pedestrians.
3. Jurisdiction and Venue
Under Batas Pambansa Blg. 129, as amended, First Level Courts possess exclusive original jurisdiction over civil actions for damages where the total monetary claim does not exceed the statutory threshold. For a claim of Php100,000, the Metropolitan Trial Court is the proper trial court. Under Rule 4 of the Rules of Court, venue for personal actions lies at the option of the plaintiff, either where the plaintiff resides or where the defendant resides.
