As a new lawyer, Attorney Novato limited his practice to small claims cases, legal counseling and the notarization of documents. He put up a solo practice law office and was assisted by his wife who served as his secretary/helper. He used a makeshift hut in a vacant lot near the local courts and a local transport regulatory agency. With this practice and location, he did not have big-time clients but enjoyed heavy patronage assisting walk-in clients.

1. Small Claims Role
Under the Revised Rules on Small Claims Cases, lawyers are strictly prohibited from appearing as counsel during court hearings. However, an attorney may assist a litigant prior to the hearing by providing legal advice and preparing the necessary forms, such as drafting the Statement of Claim or Response with attached supporting documents. This behind-the-scenes legal assistance ensures that unrepresented litigants properly present their claims or defenses while fully complying with the procedural prohibition against formal legal representation in court.
2. Unappealable Small Claims
Decisions rendered by First Level Courts in small claims cases are final, executory, and non-appealable under the Rules on Expedited Procedures. The rule aims to provide a fast, inexpensive, and summary settlement of money claims without prolonged litigation. Because no ordinary appeal lies from a small claims judgment, a party who suffers an adverse ruling cannot file a notice of appeal or a motion for reconsideration before the issuing trial court.
3. Rule 65 Certiorari
Although a small claims judgment is final and unappealable, an aggrieved party is not completely without legal recourse. If the First Level Court acted without or in excess of jurisdiction, or with grave abuse of discretion amounting to lack or excess of jurisdiction, the losing litigant may file a special civil action for certiorari under Rule 65. This petition must be filed before the Regional Trial Court within sixty days from notice of the judgment.
