1. Judicial Gross Misconduct
Under Rule 140 of the Rules of Court and the New Code of Judicial Conduct, the sale of Temporary Restraining Orders constitutes gross misconduct, bribery, and corruption. Members of the judiciary are held to the highest standards of integrity, competence, and propriety. Taking bribes or selling court orders directly undermines public trust in the judiciary and degrades the administration of justice. Such severe ethical violations constitute serious administrative offenses punishable by dismissal from judicial service, forfeiture of retirement benefits, and disqualification from holding public office.

2. Due Process Safeguards
In administrative disciplinary proceedings against judges, due process requires formal notice of specific charges and a full opportunity to present evidence and defend oneself. While the Supreme Court may order a discreet investigation through the Office of the Court Administrator based on newspaper reports or unverified complaints, a judge cannot be penalized solely on unsworn hearsay, rumors, or informal findings. The respondent judge must be furnished with a formal administrative complaint and given reasonable opportunity to confront opposing evidence.

3. Substantial Evidence Rule
The quantum of proof required in administrative disciplinary proceedings against members of the judiciary is substantial evidence. Substantial evidence means that amount of relevant evidence which a reasonable mind might accept as adequate to support a conclusion. In administrative charges involving corruption or bribery, bare allegations, newspaper articles, or unsworn statements from informal interviews do not satisfy the substantial evidence threshold without credible testimony, official documentation, or corroborating physical evidence.
