1. Required Legal Intervention
Under Section 3(b) of Republic Act No. 3019, a public officer is criminally liable for corrupt practices only when requesting or receiving a benefit in connection with a contract or transaction wherein the officer is required by law to intervene in an official capacity. The statutory requirement that the officer must be legally required to intervene is an essential element of the offense. Where no law, rule, or regulation imposes a legal duty upon the public officer to intervene in the transaction, receiving a benefit or expense reimbursement does not constitute a violation of Section 3(b).

2. Jaravata Doctrine Applied
In Jaravata v. Sandiganbayan, the Supreme Court established that an assistant high school principal who facilitates the release of salary differentials and per diems for classroom teachers does not perform an official act required by law. High school principals have no legal duty or statutory authority to intervene in the disbursement or release of public funds by the Department of Education or the national treasury. Consequently, receiving reimbursement for actual expenses incurred while voluntarily assisting teachers does not satisfy the essential elements of corrupt practices under Section 3(b) of RA 3019.

3. Strict Penal Construction
Penal laws like Republic Act No. 3019 are strictly construed against the State and liberally in favor of the accused. Courts cannot expand the coverage of a criminal statute to encompass acts that do not strictly meet every statutory element defined by Congress. Because Section 3(b) explicitly restricts liability to transactions where official intervention is mandated by law, voluntary assistance provided outside statutory duties cannot be penalized under this provision. Expanding penal liability beyond clear statutory language violates the fundamental constitutional principle of due process and legality in criminal law.
