1. Tumultuous Affray Elements
Under Article 251 of the Revised Penal Code, death caused in a tumultuous affray requires that several persons quarrel and assault each other in a confused and tumultuous manner, resulting in the death of a person, where the actual killer cannot be identified. Crucially, the participants must not compose two distinct, organized groups bound by a common purpose to assault each other reciprocally. When quarrelers belong to organized rival factions, the legal character of a tumultuous affray is absent, and the offense must be prosecuted as ordinary homicide or murder.

2. Organized Group Liability
When members of two organized rival fraternities engage in a violent clash, the assault is not an unorganized or confused affray under penal law. Because the participants form identifiable opposing factions, any death inflicted upon a member of one fraternity is necessarily committed by members of the rival faction. Implied conspiracy binds the members of the attacking fraternity who inflicted physical injuries or participated in the assault. Consequently, all participating members of the opposing fraternity incur collective criminal liability for homicide or murder as co-principals.

3. Unascertained Killer Exception
The legal provision on death caused in a tumultuous affray is a rule of exception designed for chaotic, spontaneous brawls where individual group alignments cannot be determined. In such unorganized brawls, penalizing all active participants who inflicted serious physical violence prevents impunity. However, where the victim's attackers belong to a known rival group, the law does not resort to Article 251. Instead, all participating members of the adversary group who engaged in the violent assault are held collectively responsible for the resulting death.
