2010 Criminal Law, Q7

A widower of ten years, septuagenarian Canuto felt that he had license to engage in voyeurism. If not peeping into his neighbors’ rooms through his powerful single-cylinder telescope, he would trail young, shapely damsels along the hallways of shopping malls. While going up the escalator, he stayed a step behind a mini-skirted one, and in a moment of excitement, put his hand on her left hip and massaged it. The damsel screamed and hollered for help. Canuto was apprehended and brought up on inquest. What charge/s, if any, may he be held responsible for? Explain. (5%)

1. Unjust Vexation Concept
Under Article 287 of the Revised Penal Code, unjust vexation is a broad, catch-all felony that penalizes any human conduct that, although not constituting a grave offense, causes annoyance, irritation, distress, or torment to an innocent person without legal justification. The paramount element is whether the act produced mental distress or emotional disturbance to the victim. Uninvited physical contact in public places that invades personal peace falls under this offense when lewd intent for acts of lasciviousness is not convincingly established.

2. Safe Spaces Act
Republic Act No. 11313, known as the Safe Spaces Act, explicitly defines and penalizes gender-based sexual harassment in streets, public spaces, and commercial establishments. Under Section 11, prohibited acts in public spaces include catcalling, wolf-whistling, intrusive gazing, unwanted touching, groping, or making lewd gestures that invade personal space and compromise bodily autonomy. Massaging or groping a stranger's hip or body part on an escalator without consent constitutes unwanted physical touching and gender-based public space sexual harassment under the law.

3. Acts of Lasciviousness
Acts of lasciviousness under Article 336 of the Revised Penal Code require proof of lewd design or lascivious intent accompanying the physical contact. Where physical touching occurs in a sudden, fleeting, or ambiguous manner without clear manifestation of lewd design, courts refrain from imposing the heavier felony of acts of lasciviousness. In such instances, the act is properly prosecuted either as unjust vexation under the Revised Penal Code or as gender-based sexual harassment under special penal legislation.
