2013 Legal and Judicial Ethics, Q4

Atty. Doblar represents Eva in a contract suit against Olga. He is also defending Marla in a substantially identical contract suit filed by Emma. In behalf of Eva, Atty. Doblar claims that the statute of limitations runs from the time of the breach of the contract. In the action against Marla, Atty. Doblar now argues the reverse position – i.e., that the statute of limitation does not run until one year after discovery of the breach.
Both cases are assigned to Judge Elrey. Although not the sole issue in the two cases, the statute of limitations issue is critical in both.

1. Positional Conflict
Under Canon III of the Code of Professional Responsibility and Accountability (CPRA), a lawyer is prohibited from representing conflicting interests. A positional conflict arises when an attorney takes directly opposing legal positions on a framing or critical issue of law before the same judge or tribunal in concurrent cases. Adopting contradictory legal theories before the same judge inevitably forces the attorney to argue against the legal interest of one client to advance the cause of another, thereby compromising undivided loyalty and professional independence.

2. Undivided Loyalty Duty
An attorney owes utmost fidelity, loyalty, and devotion to the cause of every client. When a lawyer advocates conflicting interpretations of a critical statute of limitations before the same trial judge, winning the issue for one client establishes adverse judicial precedent against the other client in the parallel case. This structural collision of legal arguments creates an impermissible breach of fiduciary duty and compromises the attorney's ethical obligation to zealously defend each client's cause without prejudice.

3. Disciplinary Consequences
Taking directly conflicting legal positions before the same judge exposes the attorney to serious disciplinary sanctions under the CPRA, including suspension from the practice of law or disbarment. Additionally, the attorney faces immediate disqualification from representing one or both clients in the pending actions. Courts enforce these sanctions to protect the integrity of judicial proceedings, maintain public trust in the legal profession, and prevent lawyers from placing clients in opposing legal postures within the same judicial forum.
