1. Non-Lawyer Representation Exceptions
Under Article 228 of the Labor Code and the NLRC Rules of Procedure, non-lawyers are generally prohibited from appearing before Labor Arbiters or the NLRC. However, statutory exceptions strictly permit non-lawyers to appear if they represent themselves as a party litigant, if they represent a legitimate labor organization that is a party to the case with proper authorization, or if they are accredited law student practitioners or legal aid members under recognized legal aid offices. These narrow exceptions balance the right to self-representation and union representation with the requirement of competent legal advocacy.

2. Self-Representation Rights
The right of an individual to represent themselves before labor tribunals is a fundamental statutory privilege under Philippine labor law. A party litigant, whether an employee or an employer, is not required to engage legal counsel to prosecute or defend their claims before a Labor Arbiter. When a person appears in pro per, they act as their own legal representative. However, self-representation is limited to individual claims and does not grant the non-lawyer authority to act as counsel for other co-employees or third parties without meeting other legal representation requirements.

3. Authorized Union Representation
A non-lawyer may also appear before the Labor Arbiter if properly authorized to represent a legitimate labor organization or any of its members who are parties to a labor dispute. To validly represent a labor union or its members, the non-lawyer representative must present a written authorization, such as a board resolution or power of attorney executed by the labor organization. This exception recognizes the collective interest of labor unions in protecting their members' welfare during labor standard and labor relations controversies while ensuring proper administrative authorization.
