2023 Political Law, Q4

In a fresh attempt by the President to seek a just and lasting peace with the Kapisanan ng Malayang Pilipinas (KMP), a Government Negotiating Panel (GNP) was constituted to explore options to end the internal armed conflict in the country. After months of negotiations, the GNP and KMP leadership agreed on the crucial provision in the chapter on Transitional Justice of the Agreed Framework, which states: “The Parties hereby recognize the need to arrive at genuine criminal justice. Towards this end, the GNP shall make the appropriate representation with the Senate and House of Representatives aimed at the passage of an amnesty law.” The Philippine Constitution Association questioned the provision as unconstitutional for encroaching on the clemency power of the President. On the other hand, the Office of the Solicitor General argued that the present case does not present a justiciable controversy. Who is correct? Explain your answer.

1. Amnesty Power
Under Article VII, Section 19 of the 1987 Constitution, the power to grant amnesty is an exclusive executive power vested in the President, requiring concurrence by a majority of all members of Congress. Amnesty looks backward and abolishes political offenses, completely wiping out their criminal effects. Congress cannot initiate or enact an amnesty law on its own without presidential initiation or proclamation. Any attempt to bypass the executive branch by initiating amnesty legislation directly in Congress encroaches upon the President's exclusive constitutional authority to grant executive clemency.

2. Justiciable Controversy
Judicial power under Article VIII, Section 1 of the Constitution requires an actual case or controversy involving a conflict of legal rights susceptible to judicial determination. An issue is ripe for judicial adjudication when the challenged act has produced a concrete, direct, and adverse effect on legal rights, rather than being speculative, hypothetical, or anticipatory. A mere agreement in peace negotiations committing a negotiating panel to make representations with Congress is a preliminary proposal that creates no actual, ripe controversy subject to judicial review.

3. Executive Clemency
Executive clemency encompasses the presidential powers to grant reprieves, commutations, pardons, and amnesties after conviction or for political offenses. While pardons are granted to individuals after conviction, amnesties are extended to classes of persons accused of political crimes and require congressional concurrence. The constitutional framework establishes that the initiative to grant executive clemency belongs strictly to the Chief Executive. Private agreements or negotiating panel commitments that attempt to alter or dictate the exercise of executive clemency without presidential authority are constitutionally infirm.
