1. Public Office Definition
A public office is a right, authority, and duty created and conferred by law, by which for a given period an individual is invested with a portion of the sovereign functions of government to be exercised for the public benefit. Compensation is not an indispensable element of a public office. The true test is whether the position involves a delegation of sovereign functions. Thus, an individual appointed to discharge public duties in an official capacity holds a public office regardless of whether salary or remuneration is attached to the position.

2. Anti-Graft Law Scope
Under Section 2(b) of Republic Act No. 3019, otherwise known as the Anti-Graft and Corrupt Practices Act, the term public officer is defined broadly to include elective and appointive officials and employees, whether permanent or temporary, receiving compensation or not. The law aims to prevent corruption and maintain integrity across all government bodies. Consequently, individuals exercising public functions within government commissions, ad hoc committees, or task forces fall under the jurisdiction of the Anti-Graft Law, making them criminally liable for graft and corruption committed in office.

3. Sovereign Functions Test
The essential characteristic of a public officer is the delegation of a portion of the sovereign functions of the State to be exercised for the public interest. Sovereign functions encompass executive, administrative, legislative, or judicial duties performed on behalf of the government. When an ad hoc body is created by the President to organize official national events or manage state celebrations, its officers exercise delegated administrative functions of the Executive branch. Accepting such an appointment subjects the officer to public accountability and statutory penal provisions.
