1. Assumption of Jurisdiction
Under Article 278(g) of the Labor Code, the Secretary of Labor and Employment possesses plenary power to assume jurisdiction over labor disputes causing or likely to cause a strike in industries indispensable to national interest. This assumption power is discretionary and requires no prior notice or formal hearing. Telecommunications companies like Western Phone Co. fall under national interest industries, allowing the Labor Secretary to assume jurisdiction immediately to prevent disruption of vital public utility services.

2. Status Quo Mandate
An order of assumption automatically issuing a return-to-work directive restores the status quo ante litem, which refers to the state of affairs prevailing prior to the occurrence of the strike. Under settled labor jurisprudence, all striking employees—including those whose termination sparked the labor dispute—must be readmitted to work under the same terms and conditions existing before the dispute. Modifying pre-strike conditions distorts the statutory purpose of assumption.

3. Illegal Return Exceptions
Excluding terminated or redundated employees from a return-to-work order issued pursuant to an assumption of jurisdiction is legally invalid and constitutes grave abuse of discretion. Because the termination of those workers was the very core dispute that provoked the strike, excluding them prejudges the merits of the illegal dismissal case without due process. The Labor Secretary cannot selectively modify return-to-work orders to favor employer personnel actions.
