1. Regular Seasonal Employment
Under Article 295 of the Labor Code and settled jurisprudence in Hacienda Bino v. Cuenca, agricultural workers who perform work that is necessary and desirable in the usual business or trade of the employer are considered regular seasonal employees. Their employment is not terminated during the off-season or dead season; rather, their employment relationship is merely suspended. Consequently, regular seasonal workers possess security of tenure and retain the statutory right to be rehired at the start of each succeeding planting season.

2. Illegal Dismissal Sanctions
Refusing to rehire a regular seasonal worker at the onset of a new season without a just or authorized cause under the Labor Code constitutes illegal dismissal. An employer cannot unilaterally convert a seasonal agricultural employee's status into a domestic household helper or houseboy. Such a forced reassignment or refusal to rehire severs the farm worker's employment relationship, entitling the illegally dismissed employee to full backwages, reinstatement to their former position without loss of seniority rights, or separation pay in lieu of reinstatement.

3. Domestic Worker Distinction
Under Philippine labor law, domestic workers or houseboys are governed by the Kasambahay Law (Republic Act No. 10361), whereas agricultural workers are covered by the general provisions on regular employment under the Labor Code. Performing incidental household chores during off-season periods does not divest a plantation worker of their regular seasonal employment status. An employer cannot invoke dual services to justify stripping an agricultural worker of statutory tenure and reclassifying them strictly as a domestic servant.
