1. Domestic Service Definition
Under Article 141 of the Labor Code and settled jurisprudence, a househelper or domestic worker is one who renders service in the employer's home which is usually necessary or desirable for the maintenance and enjoyment thereof, or ministers exclusively to the personal comfort, convenience, or safety of the employer's family. Driving the employer's children to and from school falls squarely under domestic service because it directly ministers to the personal convenience and safety of the family members.

2. Commercial Work Assignment
Under Article 143 of the Labor Code, no househelper shall be assigned to work in a commercial, industrial, or agricultural enterprise at a wage rate lower than that provided for agricultural or non-agricultural workers. When a domestic helper is tasked to perform duties directly related to the operation of a commercial business, such as fetching merchandise and delivering goods for a boutique, the worker is entitled to receive the statutory minimum wage applicable to commercial establishment employees.

3. Dual Employment Status
Where an employee is assigned mixed duties performing domestic chores on certain days and commercial tasks on other days, labor law applies the higher labor standards corresponding to the commercial nature of the work performed. Assigning a household driver to commercial duties converts his employment status for those specific working days into that of a commercial employee. Consequently, the employer must compensate the driver using the prevailing commercial statutory minimum wage for the days spent furthering the business enterprise.
