1. Customs Post-Audit
Under Section 1603 of the Tariff and Customs Code, as amended by Republic Act No. 9135, all importations are subject to post-audit examination by the Bureau of Customs. However, the law explicitly provides that the liquidation of an importation becomes final and conclusive three years after the date of final payment of duties and taxes, absent fraud. Once the three-year prescriptive period lapses, the Bureau of Customs is legally barred from reopening the assessment or issuing deficiency assessments against the importer.

2. Assessment of VAT
Value-Added Tax on importation is collected by the Bureau of Customs as an agent of the Bureau of Internal Revenue. However, deficiency Value-Added Tax remains an internal revenue tax under the exclusive administrative jurisdiction of the Bureau of Internal Revenue under the National Internal Revenue Code. The Bureau of Customs lacks statutory authority to independently assess deficiency Value-Added Tax after importation liquidation, as the power to audit and assess internal revenue deficiency taxes resides solely with the Commissioner of Internal Revenue.

3. Prescriptive Period Exception
The three-year prescriptive period for customs post-audit liquidation admits an exception in cases of fraud. Where an importer commits actual fraud, such as submitting false invoices or fraudulent entry documents to evade customs duties, the three-year statutory limitation does not apply. In the absence of an explicit allegation or proof of fraud by the tax authority, the general three-year prescriptive rule strictly applies, rendering any late deficiency assessment void for lack of jurisdiction.
