2014 Labor Law, Q4

Linis Manpower, Inc. (LMI) had provided janitorial services to the Philippine Overseas Employment Administration (POEA) since March 2009. Its service contract was renewed every three months. However, in the bidding held in June 2012, LMI was disqualified and excluded. In 2013, six janitors of LMI formerly assigned at POEA filed a complaint for underpayment of wages. Both LMI and POEA were impleaded as respondents. Should POEA, a government agency subject to budgetary appropriations from Congress, be held liable solidarily with LMI for the payment of salary differentials due to the complainant? 1. Indirect Employer Liability
Under Articles 106 and 107 of the Labor Code, an entity that engages an independent contractor for janitorial or security services becomes an indirect employer of the contractor's employees. In the event that the independent contractor fails to pay statutory wages or salary differentials, the indirect employer is held jointly and severally liable with the contractor. This solidary liability is limited strictly to the extent of the work performed by the contracted workers for the indirect employer's benefit, ensuring that employees receive statutory compensation regardless of the contractor's default.

2. Government Agency Exemption
Government agencies subject to congressional budgetary appropriations are not exempt from solidary liability as indirect employers under labor laws. When a government office or state instrumentality contracts out services such as janitorial or security maintenance, it assumes the statutory obligations of an indirect employer regarding unpaid wages and salary differentials. Although government funds are controlled by public budgeting rules, the statutory solidary liability under Article 106 applies equally to public and private entities to protect workers' constitutional right to just remuneration.

3. Extent of Liability
The solidary liability of an indirect employer for unpaid wages is not unlimited or perpetual. Under established labor rules, the indirect employer's financial obligation is confined strictly to the unpaid minimum wages and statutory salary differentials corresponding to the specific period during which the contractor's employees actually rendered services for the indirect employer. Once the service contract expires or is terminated, the indirect employer cannot be held liable for wage claims or monetary liabilities arising from services rendered to subsequent principals or outside the contract duration.
