2015 Legal and Judicial Ethics, Q3

Maria and Atty. Evangeline met each other and became good friends at zumba class. One day, Maria approached Atty. Evangeline for legal advice. It turned out that Maria, a nurse, previously worked in the Middle East. So she could more easily leave for work abroad, she declared in all her documents that she was still single. However, Maria was already married with two children. Maria again had plans to apply for work abroad but this time, wished to have all her papers in order. Atty. Evangeline, claiming that she was already overloaded with other cases, referred Maria’s case to another lawyer. Maria found it appalling that after Atty. Evangeline had learned of her secrets, the latter refused to handle her case.
Maria’s friendship with Atty. Evangeline permanently turned sour after Maria filed an administrative case against the latter for failing to return borrowed jewelry. Atty. Evangeline, on the other hand, threatened to charge Maria with a criminal case for falsification of public documents, based on the disclosures Maria had earlier made to Atty. Evangeline.

1. Prospective Client Privilege
Under Rule 130, Section 24(b) of the Rules of Court and the Code of Professional Responsibility and Accountability, attorney-client privilege attaches from the moment a prospective client seeks legal advice from a lawyer. The privilege exists regardless of whether the lawyer subsequently accepts or declines the engagement, or whether a formal retainer contract is executed. Disclosures made during initial legal consultations are protected to encourage full and candid communication without fear of subsequent exposure or prosecutorial retaliation.

2. Requisite Privilege Factors
To establish attorney-client privilege, three essential factors must concur: first, a legal relationship must exist or be sought between a prospective client and a lawyer; second, the communication must be made in professional confidence; and third, the communication must be made for the purpose of seeking legal advice, opinion, or assistance. When these elements coincide, the lawyer is strictly bound to maintain confidentiality and cannot divulge the client's disclosures in any proceeding.

3. Prohibition Against Disclosure
A lawyer is strictly prohibited from threatening to use or using confidential information obtained during a legal consultation against a former or prospective client. Disclosing or threatening to disclose client secrets to initiate criminal prosecution constitutes a gross breach of professional ethics and fiduciary duty. Attorney-client confidentiality survives even after the refusal of representation or the termination of friendship, ensuring absolute protection of all disclosures made within the scope of legal consultation.
