2015 Labor Law, Q10

Karina Santos is a famous news anchor appearing nightly in the country’s most watched newscast. She is surprised, after one newscast, to receive a notice of hearing before the station’s Vice-President for Human Resources and calls the VP immediately to ask what was wrong. Karina is told over the phone that one of her crew filed a complaint against her for verbal abuse and that management is duty-bound to investigate and give her a chance to air her side. Karina objects and denies that she had ever verbally assaulted her crew. The VP then informed her that pending the investigation she will be placed on a 30-day preventive suspension without pay and that she will not be allowed to appear in the newscast during this time.

1. Preventive Suspension Requisites
Under Section 8, Rule XIV, Book V of the Omnibus Rules Implementing the Labor Code, preventive suspension is justified only when the employee's continued employment poses a serious and imminent threat to the life or property of the employer or co-workers. Preventive suspension is not a penalty in itself, but a preliminary preventive measure imposed during an administrative investigation. Placing an employee under preventive suspension without meeting the statutory requirement of serious and imminent danger violates labor standards and constitutes constructive suspension or illegal penalty.

2. Due Process Requirements
Procedural due process in disciplinary proceedings requires giving the employee ample opportunity to be heard and defend herself against formal charges. The employer must issue a written notice specifying the ground for disciplinary action and afford reasonable opportunity to submit a written explanation. Imposing a preventive suspension without pay immediately upon an informal complaint without preliminary evaluation of threat level violates due process rights. Procedural protections ensure that preventive measures are not arbitrarily weaponized by management during administrative inquiries.

3. Wage Entitlement Rules
Preventive suspension must not exceed thirty days. If the employer extends the investigation beyond thirty days, the employer is legally obligated to reinstate the worker to her former position or grant payroll reinstatement. Furthermore, if the preventive suspension is found to be illegal or unjustified because no serious threat existed, the employee is entitled to full payment of back salaries and benefits corresponding to the entire period of the illegal suspension.
