1. Party Substitution Duty
Under Section 16, Rule 3 of the Rules of Court, whenever a party to a pending action dies and the claim is not thereby extinguished, it is the duty of counsel to inform the court within thirty days of the death and to give the name and address of the legal representative. This requirement ensures that the court maintains jurisdiction over the person of the deceased through proper legal substitution, allowing the action to proceed to final judgment without violating due process rights of the estate or surviving heirs.
2. Procurement of Administrator
If the counsel for the deceased party fails to name a legal representative, or if no legal representative is named, the opposing party may move for a court order directing them to procure the appointment of an executor or administrator for the estate of the deceased. The trial court orders the appointment of an administrator so that substitution can be effected. This procedural mechanism prevents the suspension or stalling of civil litigation when the heirs or legal representatives of a deceased defendant cannot be readily identified.
3. Contractual Money Claims
Under Section 20, Rule 3 of the Rules of Court, when an action is for recovery of money arising from contract, express or implied, and the defendant dies before final judgment, the action shall not be dismissed. Instead, the suit continues against the estate until final judgment. Any favorable monetary award obtained by the plaintiff is subsequently enforced as a claim against the estate of the deceased defendant under Rule 86 of the Rules of Court during special proceeding settlement.
