1. Statutory Age Threshold
Under Section 10(b) of Republic Act No. 7610, or the Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act, child abuse is committed by keeping or having in one's company a minor who is twelve years old or under, or who is ten years or more one's junior. The statutory provision requires that the age difference between the adult and the minor be at least ten years when the minor is above twelve years old. If the minor is seventeen years old and only eight years younger than the adult, the mandatory statutory age gap is absent.

2. Ejusdem Generis Rule
Under the statutory construction rule of ejusdem generis, where general words follow an enumeration of specific classes of things, the general words shall be construed as applying only to things of the same general class as those specifically listed. In Section 10(b) of Republic Act No. 7610, the phrase 'public or private place, hotel, motel, sauna parlor, massage clinic, beach resort, and other similar places' restricts covered public locations to establishments offering lodging, accommodations, or private relaxation. A public park bench does not fall under the general class of hotels or resorts.

3. Active Keeping Requisite
To incur criminal liability under Section 10(b) of Republic Act No. 7610 for having a minor in one's company, there must be an affirmative or intentional act of keeping, accompanying, or detaining the minor. Mere passive presence, such as when a minor voluntarily sits beside an adult in a public park without prior agreement or permission, does not constitute the criminal act of keeping or having a minor in one's company. Without voluntary control, inducement, or custody over the minor, no violation of the child abuse law occurs.
