1. Judicial Property Purchase
Under Article 1491(5) of the Civil Code, judges are prohibited from acquiring by purchase, even at a public or judicial auction, property and rights in litigation before the court within whose jurisdiction or territory they exercise their respective functions. This statutory disqualification aims to prevent judges from taking unseemly advantage of their position or being tempted to influence litigation for personal gain. However, this legal prohibition applies strictly and exclusively while the property or subject matter remains actively subject to ongoing litigation.

2. Property in Litigation
Property is legally considered in litigation only during the active pendency of the judicial proceedings concerning it. Once a court renders a final decision, all appeals are exhausted, and an entry of judgment is officially issued, the suit is permanently terminated. Consequently, the property ceases to be in litigation. A judge who purchases property or condominium units after the finality of judgment and entry of judgment does not violate Article 1491(5) because the litigious character of the property has already lapsed.

3. Judicial Conduct Standards
Canon 4 of the New Code of Judicial Conduct governs propriety and the appearance of propriety in all judicial activities. Judges are permitted to engage in personal financial and business dealings, including real estate transactions, provided such activities do not exploit their judicial position or create an appearance of impropriety. Buying property from a corporate litigant two years after the final resolution of a case does not constitute impropriety absent evidence of prior corrupt agreement, undue influence, or exploitation of judicial office.
